BLIND PILOTS — TERMS OF USE

AGREEMENT TO THESE TERMS
These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “player”) and Syam Affoon, operating as NAChd (New Age Classics HD) (“NAChd,” “we,” “us,” or “our”), concerning your access to and use of the mobile game Blind Pilots, including its gameplay, features, content, virtual items, and related services (collectively, the “Game”).
Blind Pilots is operated from the State of Florida, United States. By downloading, installing, accessing, purchasing content within, or using Blind Pilots, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, do not use the Game.
1. OUR GAME
Blind Pilots is a mobile video game provided primarily for personal entertainment. The Game may contain scoring, progression, virtual items, optional in-app purchases, and other features. Blind Pilots is currently distributed for Android devices, including through Google Play.
2. ELIGIBILITY
By using Blind Pilots, you represent that you have the legal capacity to agree to these Terms or that your use is authorized by a parent or legal guardian where required by law. Blind Pilots does not currently require players to create a user account or login directly with us.
3. LICENSE
NAChd grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, access, and use Blind Pilots for personal, non-commercial entertainment. This license does not transfer ownership of the Game or its intellectual property.
4. INTELLECTUAL PROPERTY
Blind Pilots and its original content are owned by or licensed to Syam Affoon / NAChd and are protected by applicable intellectual-property laws. This includes, where legally protectable, the Blind Pilots name, branding, logos, artwork, characters, vehicle designs, animations, interface, audio, software, source code, written content, and promotional materials.
5. IN-APP PURCHASES
Blind Pilots may offer optional purchases of consumable digital items known as Reality Anchors. A Reality Anchor allows a player to continue the current game run after the run would otherwise end.

Prices displayed in the Game or applicable marketplace at the time of purchase control and may vary by country, currency, taxes, marketplace requirements, or promotions.
6. GOOGLE PLAY BILLING
Android purchases are processed through Google Play where required. Your purchase is also subject to Google's applicable terms, payment requirements, and refund policies. NAChd does not directly process or store your complete payment-card information when a transaction is processed by Google Play.
7. REALITY ANCHORS
Reality Anchors are virtual consumable game items. They exist only within Blind Pilots, have no cash value, cannot be redeemed for money, are not cryptocurrency or investments, and do not represent ownership in NAChd or Blind Pilots. Purchasing them grants only a limited license to use them inside the Game.
8. USING A REALITY ANCHOR
When a run ends, the Game may offer an opportunity to use one Reality Anchor to continue. Once selected and successfully applied, one Reality Anchor is deducted and treated as consumed. Using an Anchor does not guarantee a particular score, reward, achievement, leaderboard position, or gameplay result.
9. DELIVERY OF PURCHASED ITEMS
We will make reasonable efforts to deliver legitimate purchases correctly. Delivery may be delayed by network problems, Google Play processing, device issues, software errors, outages, or other technical circumstances. If you are charged but do not receive the purchased Reality Anchors, contact wnglsj@gmail.com and include transaction information reasonably needed to verify the purchase.
10. REFUNDS
Purchases made through Google Play are subject to Google's refund policies and applicable law. Reality Anchors already consumed during gameplay ordinarily cannot be restored merely because a player is dissatisfied with the resulting gameplay outcome. Nothing in these Terms limits rights that cannot legally be waived.
11. GAME PROGRESS AND LOCAL DATA
Because Blind Pilots does not currently require a direct user account, certain gameplay data or settings may be stored locally on the device or through platform services. Deleting the Game, clearing application data, changing or losing a device, or device failure may cause loss of locally stored progress. We do not guarantee recovery of progress that was not preserved through a supported backup or synchronization feature.
12. ADVERTISING AND FUTURE FEATURES
Blind Pilots may later introduce advertising, including Google AdMob, analytics, cloud storage, accounts, leaderboards, multiplayer, or other services. If such features are introduced, additional disclosures, permissions, terms, and privacy practices may apply, and the Privacy Policy may be updated.
13. PROHIBITED ACTIVITIES
You may not cheat, manipulate scores or Reality Anchor balances, fraudulently obtain virtual items, bypass payment systems, use unauthorized modified clients, bots, scripts, hacks or automation, introduce malicious code, interfere with the Game, reverse engineer it except where law permits, distribute unauthorized copies, commercially exploit the Game without permission, falsely claim affiliation, or use it unlawfully.
14. UPDATES AND CHANGES
Blind Pilots is an evolving product. We may update, rebalance, add, modify, or remove gameplay mechanics, difficulty, vehicles, environments, scoring, graphics, audio, Reality Anchor functionality, prices, packages, game modes, advertisements, technical requirements, and other features. Changes affecting purchased digital items remain subject to applicable law and marketplace rules.
15. THIRD-PARTY SERVICES
Blind Pilots may depend on Google Play and other third-party services. Those services are governed by their own policies and availability. We are not responsible for failures caused solely by systems outside our reasonable control.
16. PRIVACY
Your use of Blind Pilots is also subject to our Privacy Policy. If our data practices materially change, including through advertising or additional SDKs, the Privacy Policy may be updated.
17. AVAILABILITY
We do not guarantee uninterrupted availability. The Game may be unavailable because of maintenance, updates, bugs, technical failures, security issues, marketplace outages, legal requirements, device incompatibility, or events outside our reasonable control.
18. DISCLAIMER
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLIND PILOTS IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT WARRANT THAT THE GAME WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPATIBLE WITH EVERY DEVICE. NO PURCHASE GUARANTEES A PARTICULAR SCORE OR GAMEPLAY RESULT.
19. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Syam Affoon, NAChd, and applicable contractors, licensors, or service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use Blind Pilots. Nothing here excludes liability that cannot legally be excluded.
20. INDEMNIFICATION
To the extent permitted by law, you agree to be responsible for claims, losses, liabilities, and reasonable expenses arising from your intentional misuse of Blind Pilots, violation of these Terms, or infringement of another person's rights.
21. TERMINATION
You may stop using the Game at any time. We may restrict functionality when reasonably necessary to address fraud, security threats, unlawful activity, cheating, abuse, or material violations of these Terms. We may also discontinue the Game, subject to applicable consumer law and marketplace requirements.
22. GOVERNING LAW
These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles. This does not deprive consumers of mandatory protections that apply in their jurisdiction.
23. DISPUTE RESOLUTION
Before filing formal legal proceedings, you and NAChd agree, where reasonable, to attempt to resolve disputes informally. Contact wnglsj@gmail.com with enough detail to identify the issue and requested resolution. Nothing here prevents either party from exercising rights that cannot legally be restricted.
24. SEVERABILITY
If any provision is invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
25. NO WAIVER
Failure to enforce a provision does not waive the right to enforce it later.
26. CHANGES TO THESE TERMS
We may update these Terms because of changes to the Game, law, marketplace requirements, or business practices. The “Last Updated” date will be revised. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.
27. ENTIRE AGREEMENT
These Terms, the Privacy Policy, and any additional terms properly presented for specific features constitute the agreement between you and NAChd regarding Blind Pilots.
